Future of Healthcare Delivery at a Crossroads

Examining the challenge to the Individual Mandate (IM) that was discussed by the Supreme Court in late March (they will announce their decision in early summer), the key questions appear to be:
  • Is the IM constitutional?
  • Is an unconstitutional IM severable from the rest of the law or does a stricken IM invalidate the entire law?
  • If IM is found to be unconstitutional and can be severed, thus making the rest of the law still valid, can HCR succeed without it?
